Judicial Clash : Former Judge’s Lawsuit Challenges Chief Justice’s Decision

Former Jasikan Circuit Court Judge, Alfred Kwabena Asiedu, ousted over alleged misconduct, has initiated legal action against the Judicial Service, Chief Justice Her Ladyship Justice Gertrude Torkornoo, and the Attorney General. His dismissal by the Chief Justice, who accused him of abusing power and sexually exploiting a client seeking legal redress, has prompted Mr. Asiedu to challenge the decision, now claiming his removal was ‘unlawful.’

Initially dismissing the accusations as the petitioner’s imagination, Mr. Asiedu is now petitioning the court to declare his removal outlined in the November 13, 2023 letter, signed by the 2nd Respondent (Chief Justice), as unlawful. He seeks declarations asserting that both the Disciplinary Committee and Judicial Council exceeded their authority in finding him guilty of malicious prosecution. Mr. Asiedu argues that these findings constitute a patent error of law on the record, urging the court to quash them using its supervisory powers.

The controversy arose when Singari
Diana Sadia petitioned the Chief Justice on January 16, accusing Judge Asiedu of abuse of power, sexual exploitation, malicious prosecution, and impropriety in a divorce case. Following this petition, the matter was transferred to the disciplinary committee of the Judiciary Service, which conducted a thorough investigation. The committee ultimately recommended the dismissal of Judge Asiedu based on the serious allegations brought forth by Singari Diana Sadia.

In response to the disciplinary findings, Chief Justice Torkornoo issued a letter instructing Judge Asiedu to surrender all official properties, including his official vehicle, dockets, and record books, to the Judicial Secretary. This directive accompanied the decision to dismiss Judge Asiedu from the Jasikan Circuit Court.

Now, with legal proceedings initiated by the ousted judge, the dispute takes a new turn as Alfred Kwabena Asiedu seeks to challenge the legitimacy of his removal. The allegations, initially denied by Mr. Asiedu, are at the center of a legal battle questioning the authority and procedures followed by both the Disciplinary Committee and the Judicial Council in arriving at their conclusions. The unfolding case sheds light on the complexities surrounding judicial conduct and the mechanisms in place to address allegations of misconduct within the legal system.
