The Deputy General Secretary of the New Patriotic Party , Lawyer Obiri Boahen has described as horrible and serious error a statement of relief in the National Democratic Congress 2020 Presidential Candidate’s Petition to Supreme Court asking for a re run between the Petitioner and the principal respondent, who is the Electoral Commission,EC .
” An order of mandatory Injection directing the first respondent to proceed to conduct a second election with the petitioner and the first respondent, as candidate as required under article 63(4) and (5) of the 1992 constitution ”
Nana Obiri Boahen expressed shock about how the team of the Counsel couldn’t recognized a particularly significant issue which was the center to their appeal to the Supreme Court.
“How might that occur, in what capacity can the petitioner contest a presidential election with the Electoral Commission and by extension the Chair person , Mrs Jean Mensah and her Commissioners.This is serious .
Legal advisor to NPP Obiri Yeboahen offered this expression when he was talking on the Kumasi based Akoma Fm.
He repeated that this blunder couldn’t have occurred if the team of Counsel was extra meticulous and also committed to investigate everything about the request.
“In issues in this nature it expects one to be an extra careful .At least in issues like this one needs around 7 to 10 lawyers to look at the issues fundamentally.
” If the lawyers were around 10, wouldn’t you say one of them might have recognized this mistake .This blunder couldn’t have occurred.
“For example for our situation , we gathered around ten lawyers .We possibly go out when we need to pass water ,eat or drink water.
Legal Counselor Obiri Boahen contended that this was appropriate to place things fit as a fiddle.
“This gives space for individuals to more readily investigate each sentence in order to recognize any blunder.
This is certifiably not a small exercise .For us we invested a great deal of energy working .We quit working around 2am and I returned home around 3am.
“The issue involved is that you must be deligent by looking into all alternatives to all sides and points to the issues.
“You need to investigate the issue to understand what your opponent will say and what responds you need to consider so as not to be taken unawares.”,he focuses
The National Democratic Congress requested of the Supreme Court to over turn the results of Ghana’s Presidential election , saying the incumbent President Akufo-Addo’s success was illegal.The case could be an impetus for future reference .
Ghana’s generally election on December 7 saw incumbent Nana Akufo-Addo of the New Patriotic Party (NPP) announced the champ with 51.59% of the vote, in front of his principle challenger, former President John Mahama of the opposition National Democratic Congress (NDC) , who got 47.37%.
While defeated opposition regularly conceed in Ghana, Mahama on Wednesday requested of the Supreme Court to annul the outcomes of the presidential elections.
The NDC is asking the Supreme Court to annul Akufo-Addo’s success. John Mahama contends that the announcement of the incumbent as victor was illegal in light of the fact that no candidate tied down the necessary number of votes to be announced champ
