Woman Sentenced Six Months On Charges Of Sexual Assault After Punching Holes In Boyfriend’s condoms

A German  woman has been given six months suspended sentence for committing sexual assault after punching holes in her boy’s friend’s condoms trying to get pregnant, reports reveal.

The lady, 39, was in a “companions with benefits” relationship with the man when she purposely damaged the condoms without his consent.

The case made legal history, as per the judge , on the grounds that the crime known as “stealthing” – where a man furtively eliminates the contraceptive during sex – was in this instance perpetrated by a lady.
She was committed to a six-month suspended sentence.

The pair met online toward the start of 2021 and started an casual, sexual relationship.

She created further affections for her partner , 42, however realized he would have rather not been in a serious relationship, as indicated by the Bild newspaper.

The lady secretly punched holes in the parcel of condoms in the expectation of getting pregnant, however was supposed to be unsuccessful.

Regardless of this, she later sent the man a WhatsApp message saying she believed she was pregnant – and let him know what she had done.

He in this way brought a complaint against her.

In spite of the fact that prosecutors and the court concurred a crime had been carried out, there was initial uncertainty over what she ought to be accused of.

“We have written legal history here today,” Judge Astrid Salewski told the regional court in the western city of Bielefeld.

After first investigating whether the crime constituted assault, she concluded a charge of rape was fitting subsequent to reading about the crime of stealthing while at the same time checking on case law.

The judge explained in her decision: “This arrangement additionally applies in the converse case.

“The condoms were rendered unusable without the man’s consent or his knowledge .”

She added: “No means no here also.”
